PRIVACY
Australian Nano Business Forum Limited's full privacy policy is set out below. Throughout this policy the following definitions apply:
Personal information means information or an opinion (including information or an opinion forming part of a database), whether true or not, and whether recorded in a material form or not, about an individual whose identity is apparent, or can reasonably be ascertained, from the information or opinion, including e-mail addresses or information transmitted by e-mail.
Sensitive information means Personal Information or an opinion about an individual's:

(ii) political opinions; or
(iii) membership of a political association; or
(iv) religious beliefs or affiliations; or
(v) philosophical beliefs; or
(vi) membership of a professional or trade association; or
(vii) membership of a trade union; or
(viii) sexual preferences or practices; or
(ix) criminal record;

1. Collection of Personal Information
1.1 Australian Nano Business Forum Limited will only collect Personal Information where it is necessary for one or more of our legitimate functions or activities and will only collect it by lawful and fair means and will not in any circumstances collect it in an unreasonably intrusive manner.
1.2 If it is reasonable and practicable to do so, we will only collect Personal information where it is provided by you.
1.3 At or before collecting any Personal information from you (and if that is not practicable as soon as practicable thereafter) we will take reasonable steps to ensure that you are aware of:

(a) who we are and how to contact us;
(b) what we normally do with such information (i.e. to whom we usually disclose such information);
(c) any law requiring us to collect the information;
(d) the fact that you can gain access to the information held by us;
(e) why we need the information (i.e. for what purpose); and
(f) what happens if we do not obtain it.

1.4 If we are provided with Personal information about you by a third party, we will take reasonable steps to make you aware of that fact and of the matters listed in 1.3 above unless that would pose a serious threat to the life or health of someone.
1.5 Wherever it is lawful or practicable to do so, we will allow you the option of not identifying yourself when you enter into a transaction with us.
1.6 We will not collect Sensitive information about you unless:

(a) you consent; or
(b) it is required by law; or
(c) it is necessary to prevent or lessen a serious and imminent threat to the life or health of any individual in cases where that individual is physically or legally unable to give consent or physically cannot communicate the consent; or
(d) it is necessary for the establishment, exercise or defence of an actual, pending or potential legal or equitable claim.

2. Use and Disclosure of Personal Information
2.1 Where we require the use or disclosure of the information for any purpose other than that for which it was collected:

(a) we will only use it if the secondary purpose is related to the purpose for which it was collected and you have agreed or you would reasonably expect us to use it in that way.
(b) If the information is Sensitive Information we will only use it if the secondary purpose is directly related to the purpose for which it was collected and the previous conditions apply.

2.2 We may also use and disclose Personal information for direct marketing purposes without consent if it is impracticable for us to obtain your consent before doing so. You may indicate that you do not wish to receive direct marketing material. We will give you notice of your right to decline to receive the direct marketing material at no cost.
2.3 At all times we reserve the right to use or disclose information in the following circumstances:

(a) if we reasonably believe the use or disclosure is necessary to prevent or lessen a serious and imminent threat to an individual's life, health or safety or a serious threat to public health or safety;
(b) we have reason to suspect that unlawful activity has, is or may be involved and it is necessary as part of an investigation or for reporting to relevant authorities or persons;
(c) it is required or authorised by law;
(d) we reasonably believe it is necessary for reasons related to investigations, detection, prevention, enforcement, prosecution, protection, remedying, proceedings, orders or punishment under law by or on behalf of an enforcement body. In these cases we will make written notes of the use or disclosure.

2.5 The policies listed above in relation to the collection of Personal information will operate, in the case of collection from a related body corporate of Australian Nano Business Forum Limited, as if the primary purpose of the collection by the related body corporate was the primary purpose of Australian Nano Business Forum Limited for the collection.
3. Security, Storage, Retrieval and Quality
3.1 Australian Nano Business Forum Limited undertakes to take reasonable steps to ensure that the Personal information it collects, uses and discloses is accurate, complete and up to date. Should you establish that this is not the case we will take reasonable steps to correct the information held by us. If we disagree as to whether the information is accurate, complete and up to date, on your request, we will take reasonable steps to associate a statement with the information to that effect.
3.2 We will take all reasonable and practical steps to protect Personal information in our possession from misuse and loss and from unauthorised access, modification, transmission and disclosure, including the use of firewalls and encryption technologies.
3.3 Should Personal information no longer be required by us, we undertake to take reasonable steps to destroy, delete or de-identify the information.
3.4 Should you wish to know the Personal information held by us about you, upon your request we will take reasonable steps to let you know, generally, what sort of information we hold, for what purposes, and how we collect, hold, use and disclose that information.
3.5 We will provide you with access to the Personal information we hold about you on your request unless the provision of access to the information would:

(a) pose a serious and imminent threat to the life or health of someone;.
(b) have an unreasonable impact on the privacy of others;
(c) result from a request that is frivolous or vexatious;
(d) relate to a legal proceeding between us and you and is not accessible through the process of discovery;
(e) be prejudicial in revealing our intentions in negotiations between us and you;
(f) be unlawful or likely to prejudice an investigation of possible unlawful activity;
(g) if the denial of access is required or authorised by law;
(h) be likely to prejudice investigations, detection, prevention, enforcement, prosecution, protection, remedying, proceedings, orders or punishment under law by or on behalf of an enforcement body; or
(i) we are asked by an enforcement body not to provide access as to do so would be likely to damage national security.

In the above circumstances we will, if reasonable, consider whether the use of a mutually agreed intermediary would allow sufficient access to meet both our needs.
3.6 We reserve the right at all times to deny access to evaluative information generated by us connected to commercially sensitive decision making processes. In such cases we may give you an explanation for the commercially sensitive decision rather than direct access to the information.
3.7 We reserve the right to charge a reasonable fee for access to Personal information held by us. This fee will not apply to the lodging of a request for access.
3.8 We undertake to provide you with our reasons for denying access or refusing to correct Personal information.
3.9 We will not adopt as our own any identifier for you, including an identifier that has been assigned to you by an agency, an agent of that agency acting in that capacity or a contracted service provider of a Commonwealth contract acting in that capacity (unless this is prescribed in regulations). We will only use or disclose such identifiers as required or authorised by law. Please note that your name or ABN is not an identifier.
3.10 We will only transfer Personal information to someone in a foreign country if:

(a) we reasonably believe that they are subject to a law, binding scheme or contract which upholds principles for fair handling that are substantially similar to the National Privacy Principles under the Privacy Act; or
(b) you have consented; or
(c) it is necessary for the performance of a contract between us and you or for the implementation of pre contractual measures in response to your request; or
(d) it is necessary for the performance or conclusion of a contract concluded in your interest between us and a third party; or
(e) it is for your benefit, it is impracticable to obtain your consent and you would be likely to give your consent; or
(f) we have taken reasonable steps to ensure that the information will not be held, used or disclosed inconsistently with the National Privacy Principles under the Privacy Act.
